Lockwood v. Sheppard, Mullin,
Richter & Hampton
Background
Inventor brought action against attorney and law firm that represented alleged patent infringers, alleging malicious prosecution, intentional interference with prospective economic relations, and fraudulent misrepresentations based on attorney's actions in obtaining patent reexamination. Defendants moved to strike complaint under anti-SLAPP (strategic lawsuits against public participation) statute. The Superior Court, Los Angeles County, No. BC372160, John Shepard Wiley, Jr. and Reginald A. Dunn, JJ., granted motion, but denied defendants attorney fees.
Holdings
On cross-appeals, the Court of Appeal, Willhite, J., held that inventor's complaint was subject to the exclusive jurisdiction of the federal courts.
Vacated and remanded with directions.
