United States v. Thompson

Background

Defendant was indicted for conspiracy to commit wire fraud and to manipulate gas prices in violation of Commodities Exchange Act. The United States District Court for the District of Columbia, granted defendant's motion to compel production of documents his employer had produced to government during investigation of alleged improper trading prac-tices. Employer filed third-party appeal, seeking to enforce confidentiality agreement with government.

Holdings

The Court of Appeals, Rogers, Circuit Judge, held that:
(1) discovery order was immediately appealable by employer;
(2) employer voluntarily participated in disclosure program, thus weighing against wok-product protection;
(3) employer had standing to seek enforcement of confidentiality agreement;
(4) disclosure of documents was not within scope of confidentiality agreement;
(5) assurances of confidentiality were neither sufficiently strong nor unqualified to warrant application of work product doctrine; and
(6) general conclusion that defendant was entitled to disclosure was insufficient given scope of confidentiality agreement.
