Davis v. Scott

Background

Client brought legal malpractice action against attorney, alleging that attorney gave incorrect legal advice with regard to a non-solicitation agreement. The Circuit Court, Hardin County, Robert A. Miller, J., dismissed client's claim. Client appealed.

Holdings

The Court of Appeals, Dixon, J., held that:
(1) addressing an issue of first impression, client's assignment of proceeds from legal malpractice claim was equivalent of assignment of claim itself, and thus unlawful, and
(2) client's legal malpractice action could not be maintained apart from unlawful assignment of mal-practice claim.

Affirmed.
